A Divorce or Legal Separation is a very rough process on both parties and the children if any. The spouse who initiates the filing of a divorce is named the Petitioner and the spouse who responds is named the Respondent.

The most common grounds where the Court will grant a Petition for Dissolution of Marriage or Petition for Legal Separation is “Irreconcilable Differences which have caused the irremediable breakdown of the marriage”.

An irreconcilable difference means that either party has formed the opinion that their relationship has broken down to such an extent that no form of counselling or therapy will help the parties reconcile.

Once a Petitioner files for Divorce and certain legal requirements are satisfied, the court has authority to make orders regarding child support, spousal support, custody, visitation, and property and debt division.

A Nullity of Marriage action is an action by one spouse to deem the marriage unlawful because of conditions that existed at that time of marriage.

Marriages which are entered into by virtue of fraud and duress and those in which one spouse was sexually impotent at the time the marriage was entered into unbeknownst to the other spouse are examples of marriages that will support an order for nullity of marriage.

A decree of a nullity of marriage means that the parties were never married and therefore, will not have any obligations to each other under the law.

A Nullity of Marriage action is available to spouses who have been married for two years or less, have not acquired property jointly, and there are no children at issue.

Courts ordinarily will enter a judgment of dissolution of marriage six months after the date the Petitioner files for Divorce.

This six month waiting period is rooted in the public policy to promote reconciliation once the parties have actually filed for a divorce.

Although each case is different, unless the parties come to an agreement, it is rare to see a dissolution action finalized within these six months.

California is a “Community Property” state, which means that absent any agreement otherwise (commonly known as a Prenuptial Agreement or Postnuptial Agreement), all property acquired by a couple during their marriage is presumed to be community property and each party has an undivided one-half interest in the property. It does not matter whose name the property is currently in.

The only thing the Courts will look to is when was the property acquired or purchased. The courts have broad power to award assets to either party in order to equalize the division of the parties’ assets.
